Terms of Use
These Terms of Use ("Terms") govern your use of the ProperHabit iOS app (the "app"). By downloading, installing or using the app, you agree to these Terms. If you do not agree, please do not use the app.
1. Who we are and what these Terms cover

These Terms sit alongside two other documents, all of which apply:
- the End User License Agreement (EULA), which is the licence for the app itself;
- the Privacy Policy, which explains what we do and do not do with data;
- Apple's Media Services Terms and Conditions, which govern your App Store account and every purchase you make through it.
If these Terms conflict with mandatory provisions of the Apple Standard EULA or with mandatory consumer law that applies to you, the mandatory provision prevails.
2. Your licence to use the app
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the app on Apple-branded devices that you own or control, for your own personal, non-commercial use, as permitted by the App Store Terms of Service.
The app is licensed, not sold. All rights not expressly granted to you are reserved by us and our licensors.
3. Free plan and Premium
ProperHabit can be used free of charge, without an account, for up to six habits. The free plan includes tracking, schedules, streaks, grace days, local reminders, widgets and the on-device statistics screen.
ProperHabit Premium removes the limit and unlocks the premium features:
- unlimited habits;
- automatic habit completion from Apple Health (steps, sleep and mindfulness minutes);
- sync across your own Apple devices through your private iCloud storage;
- data export and backup — CSV, JSON and a database backup file.
Premium is available as two auto-renewable subscriptions and one one-time purchase. The exact plans, their lengths and how they renew are set out in the next section.
4. Subscriptions, prices and renewal
The table below is the subscription disclosure required by Apple's App Store guidelines. It applies wherever Premium is offered.

How payment and renewal work
- Payment is charged to your Apple Account at confirmation of purchase.
- Both subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period.
- Your Apple Account is charged for the renewal within 24 hours before the current period ends.
- The 7-day free trial applies to the annual plan only. The monthly plan and the lifetime purchase have no trial. If you do not cancel at least 24 hours before the trial ends, the annual subscription starts and the annual price is charged.
- The lifetime purchase is not a subscription. It is charged once and never renews.
- Deleting the app does not cancel a subscription. You must cancel it in your Apple Account.
Prices
The amounts in the table are the reference prices configured for the app, expressed in US dollars. Apple sets and displays the price for your region, and the price actually charged is the one the App Store shows you before you confirm the purchase. That in-app price is the authoritative one; where it differs from this table, the App Store price applies. Prices may change for future periods, and Apple will notify you in advance as required by the App Store rules.

5. Cancelling, refunds and withdrawal rights
Cancelling a subscription
Subscriptions are managed by Apple, not by us. To cancel, open Settings → your name (Apple Account) → Subscriptions on your iPhone, choose ProperHabit Premium and tap Cancel Subscription. You keep Premium until the end of the period you already paid for; cancelling does not cut access short and does not refund the current period.
Refunds
All purchases are processed by Apple and refunds are granted by Apple, not by us. We cannot see your payment, cannot issue a refund and cannot reverse a charge. Request a refund at reportaproblem.apple.com, or see Apple's guidance on requesting a refund for App Store purchases.
Your EU/Polish consumer rights
Where you deal with us as a consumer, nothing in these Terms removes rights you have under mandatory law.
- App Store purchases are concluded with Apple. The contract for the purchase itself is between you and Apple under Apple's Media Services Terms; Apple handles billing, cancellation and refunds. The licence to use the app itself is granted by us under these Terms and the EULA.
- Right of withdrawal (14 days). If you are a consumer in the EU or EEA and you buy digital content from us outside the App Store, you normally have 14 days to withdraw from the contract without giving a reason. For digital content supplied immediately, that right is lost once performance begins with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal. We do not currently sell the app or Premium anywhere except the App Store, so in practice this right does not arise today — but it will apply to any future direct sale.
- Complaints (reklamacja). You may complain about the app, a purchase or a feature by writing to hi@zordonintelligence.pl. We will answer in English or Polish.
- Out-of-court redress. As a consumer you may seek help from the Polish municipal or district consumer ombudsman (miejski/powiatowy rzecznik konsumentów), from the Office of Competition and Consumer Protection (UOKiK), or use the European Commission's online dispute resolution platform.
- Conformity. We are liable for the conformity of digital content with the contract under Polish consumer law. If a feature you paid for does not work as described, tell us — we will fix it, or you may be entitled to a price reduction or termination of the contract with Apple as applicable.
6. Acceptable use
You agree not to:
- copy, modify, distribute, sell, rent, lease, sublicense or commercially exploit the app, in whole or in part;
- reverse-engineer, decompile or disassemble the app, except to the extent that this restriction is prohibited by applicable law;
- circumvent, disable or interfere with any technical protection, entitlement check or feature limit of the app;
- remove or obscure any proprietary notice, copyright notice or attribution in the app;
- use the app in a way that breaks the law, or that infringes anyone else's rights;
- record or track data about another person in the app without their consent.
7. Health, fitness and medical disclaimer
ProperHabit is a self-tracking and motivation tool, not a medical device. It does not diagnose, treat, cure or prevent any condition, and it does not provide medical, nutritional, psychological or fitness advice.
Habit targets, suggested defaults, streaks, scores and on-device insights are informational and motivational only. They are not a clinical recommendation and are not tailored to your health. Apple Health values shown in the app come from your device and from apps and sensors you have authorised; they may be incomplete or wrong, and you should not rely on them for any health decision.
Do not use the app to replace advice from a qualified professional. Before starting or changing any exercise, sleep, mindfulness or other health-related routine, consult a doctor or another qualified professional — particularly if you are pregnant, recovering from illness or injury, or managing a medical condition. If you feel unwell while following a habit, stop and seek medical help. In an emergency, contact your local emergency number.
8. Availability, updates and changes to the app
The app runs on your device and needs no server of ours, so it generally works without an internet connection. Even so, we do not guarantee that the app will always be available, that it will work on every device or iOS version, or that any particular feature will remain in future versions.
We may release updates, change features, or discontinue the app. If we discontinue a paid feature, we will describe the effect in the release notes. Your data stays on your device regardless — we cannot remove it and neither can a discontinued feature.
Because the app stores data locally, keeping your own backup is your responsibility. Use the export and backup options in the app, or enable iCloud sync, if your history matters to you.
9. Disclaimer of warranties
To the maximum extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the app will be uninterrupted, timely, error-free or secure, that defects will be corrected, or that the app will meet your expectations about habit formation or any particular result. Habit change depends on many factors outside our control, and we promise no outcome.
Nothing in this section limits any warranty or right that cannot be excluded under the mandatory law that applies to you, including Polish consumer law.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, or loss of data, arising out of or related to your use of, or inability to use, the app.
We specifically draw your attention to data loss: the app stores your history locally on your device, so uninstalling the app, losing the device, restoring it without a backup, or deleting data in the app will delete that history. We cannot restore it, because we never receive it.
Our total aggregate liability under these Terms is limited to the greater of (a) the amount you actually paid for the app and Premium in the twelve months before the event giving rise to the claim, and (b) the minimum amount required by applicable law.
We do not exclude or limit liability where that would be unlawful — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that Polish or EU law does not allow to be excluded. Mandatory consumer rights are unaffected.
11. Termination
These Terms apply for as long as you use the app. You may terminate them at any time by deleting the app from your devices. We may suspend or terminate your licence if you materially breach these Terms — for example by attempting to circumvent the Premium entitlement.
On termination, the licence in section 2 ends and you must stop using the app. Sections that by their nature should survive termination — including the health disclaimer, disclaimers, limitation of liability, and governing law — survive. Deleting the app has no effect on a subscription: you must cancel that with Apple (section 5).
12. Governing law and jurisdiction
These Terms are governed by the law of the Republic of Poland. If you are a consumer resident in another EU/EEA country, you also benefit from the mandatory protections of the law of your country of residence, and nothing here takes those away.
Subject to the paragraph below, the courts of Łódź, Poland, have jurisdiction. If you are a consumer, you may also bring proceedings in the courts of your own country of residence, and mandatory rules on jurisdiction prevail over this clause.
Before starting any proceedings, please write to hi@zordonintelligence.pl — most issues are resolved faster by email than by a court.
13. Changes to these Terms
We may update these Terms when the app or the law changes. The "Last updated" date at the top shows the current version. If a change is material and affects your rights, we will announce it in the app or in the App Store release notes before it takes effect. Continuing to use the app after an update means you accept the revised Terms. If you do not accept them, stop using the app and — if you have a subscription — cancel it with Apple.
